Outline

These terms and conditions are meant to establish the basic working relationship between Label K LLC and it's customers. For purposes of the following:

"We" and "our" refer to Label K LLC.
"You" and "your" refer to the individual or company purchasing products and/or services from Label K LLC.

By purchasing, you are agreeing to these terms and conditions. The web address to this page will be on your invoice, and will be provided any other time at your request. We reserve the right to revise these terms and conditions at any time. It is your responsibility to be informed of the current agreement.

Process

The specifics of our work plan are determined on a case by case basis. This section provides a summary of what to expect.

Pricing is based on the specific item number, order quantity, and decoration choice.
A quote (verbal, e-mail, or text) will be provided to you prior to production; mockups will be provided when applicable. Formal quotes will be provided upon request.
Standard lead time is within seven business days for most orders. This can vary, therefore, if you have a preferred fulfillment date it is your responsibility to communicate it. We will make every effort to accommodate the requested date.
Rush orders (less than 72 hour turnaround time) may incur an additional fee.

Compensation

The following includes payment information as well as our expectations for the customer.

Card payments are accepted via PayPal. You do not need an account associated with PayPal to use this service. Processing fees apply. All card payments are subject to these terms along with PayPal's terms of service.
Cash and check are always accepted.
Individuals placing orders on behalf of themselves should make payments prior to or upon fulfillment.
Individuals placing orders on behalf of a company should make payments within 30 days of the invoice date. These individuals should make this expectation clear to their company's billing department.
If the payment is not received by the due date, a 1.5% fee, compounded monthly, will be added to the invoice total every month until the account balance is brought current.
We reserve the right to cease work on any orders in progress or dismiss any future orders until the outstanding balance is paid in full.

In the event we decide to pursue legal action to receive payment, we will be entitled to the full amount of the payment in question, along with any reasonable legal fees accrued.

Disputes

Unfortunately, customized items are non-refundable. It is the responsibility of the customer to notify us prior to production if the quote or mockups are not satisfactory. In the event you receive the wrong order or are otherwise unhappy with your order, we will make every effort to resolve the situation through replacement or future discount. If you do not notify us of the issue within 14 days of fulfillment, the order will be deemed satisfactory, therefore exempting it from any remedial efforts.

There are two scenarios our company's copyright policy addresses:

You submit works to be included in your order
We create works to be included in your order

By submitting works for us to use in your order, you are agreeing that it is an original work and you give us permission to use the work for the purpose of your order. In the event that you submit works that you did not originate, you are agreeing that either

a) you are authorized to give us permission to use the works or

b) you have acquired a license from the originator stating you may have the work reproduced by a third party, in this case, Label K LLC.

When you submit works to be used in your order, we acknowledge that the permissions granted to us for use are temporary and we will not use your work in deliverables for any other customer of ours.

When we create works to be used in your order we are in no way giving you the rights to these works, nor are we granting you or your company exclusivity to these works. This means elements used in the work presented to you may have been used for other customers in the past and may be used for other customers in the future. If the works created by us are used without our consent, you will be responsible for purchasing a license for the work along with revenue lost in the time prior to you obtaining the license.

All other existing copyright laws are applicable.
